You confirm that all information you provide is accurate, current and complete, and you agree to update it promptly if it changes.
Account Security You are responsible for:

These rights do not affect your statutory consumer rights for products you have already ordered.

Placing an Order When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. Your order is not accepted until we confirm acceptance, usually by email. We must receive and process your payment before we accept your order.
Order Changes and Cancellations Please review your order carefully before submitting. Once we have accepted your order, we may be unable to accommodate cancellation or change requests, though we will try to help where possible.
Your Right to Cancel As a consumer, you have the legal right to cancel your order within 30 days of receiving your products, under the Consumer Contracts Regulations 2013. To exercise this right:
- Notify us of your decision to cancel within 30 days of delivery
- Return the products to us within 30 days of notifying us
- The products must be unused and in their original condition
Exceptions: You cannot cancel an order for products that have been personalised or customised to your specifications, as these are made specifically for you.

Personal Use You confirm that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Pricing All prices displayed on our website are in pounds sterling (GBP) and include VAT at the applicable rate. We cannot yet receive payment in other countries or ship abroad. Please contact us if you have a requirement for this.
The price you pay will be the price shown at the time you place your order, as confirmed in your order confirmation email.
We reserve the right to change prices, discounts, and promotions at any time without notice. However, price changes will not affect orders we have already accepted.
Prices shown on our website may differ from those in physical stores or other online retailers.
What's Included Unless expressly stated otherwise, prices shown do not include:
- Shipping and handling charges
- Customs or import duties (for international orders, when available)
These additional charges, where applicable, will be clearly shown before you complete your purchase.
Payment Information You agree to provide current, complete and accurate payment and billing information. You must promptly update this information, including your email address and payment card or other payment method details, to enable us to complete transactions and contact you as needed.
You confirm that:
- The payment information you provide is true, correct and complete
- You are authorised to use the payment method provided
- Your payment provider will honour charges incurred
- You will pay all charges at the prices stated, including any applicable taxes, shipping and handling fees
Promotional Terms From time to time, we may offer promotions that affect pricing. These promotions are governed by their own specific terms and conditions. If there is any conflict between promotional terms and these Terms, the promotional terms will take precedence for that promotion.
SECTION 5 - SHIPPING AND DELIVERY
Delivery Estimates All delivery times we provide are estimates only and are not guaranteed. We will make every reasonable effort to deliver within the estimated timeframe.
Delivery Responsibility We are responsible for any products ordered until they are delivered to you, your premises or to a person you have authorised to receive them on your behalf. Risk and ownership pass to you upon delivery.
Delays While we are not liable for delays caused by circumstances beyond our reasonable control (such as carrier delays, extreme weather, customs processing, or industrial action), we remain responsible for delivering your order within a reasonable time.
If there is a significant delay, you have the right to:
- Contact us to discuss the situation
- Cancel your order and receive a full refund if delivery is unreasonably delayed
Failed Deliveries If delivery cannot be completed (for example, due to an incorrect address you have provided, or no one being available to receive the parcel), additional delivery charges may apply for re-delivery attempts.
International Orders For deliveries outside the UK (when available), you may be responsible for customs duties, import taxes, and clearance fees imposed by your country. These are beyond our control and are your responsibility to pay.
Rush Orders We offer the option of a ‘Rush Order’ for our diaries. This means your diary will be manufactured within 2 Working Days (Monday to Friday). Your diary will be dispatched no later than the 3rd working day after your order (we will always strive to be as quick as possible).
If your diary is not dispatched by the 3rd day, we will contact you. We may offer a refund for the Rush Order fee. You may request a refund for the diary. However if your item is in any way customised, we cannot refund the whole cost of the diary. Your Statutory Rights are not affected.
Rush order fees are not refundable in the event of a product return.
SECTION 6 - INTELLECTUAL PROPERTY
Our Content All content on our Services, including but not limited to trademarks, logos, text, images, graphics, product descriptions, reviews, videos, audio, and the design, selection and arrangement of these materials, are owned by Ballavimus, our affiliates, or our licensors. This content is protected by UK and international intellectual property laws, including copyright, trademark, and design rights.
Your Use These Terms permit you to use the Services for your personal, non-commercial use only.
You must not, without our prior written consent:
- Reproduce, copy, or duplicate any content from the Services
- Distribute, modify, or create derivative works from our content
- Publicly display, perform, republish, download, or store our materials
- Use our content for commercial purposes

Your Responsibility Any use of third-party tools is entirely at your own risk and discretion. Before using any third-party tool, you should:

Ballavimus is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Ballavimus.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Ballavimus, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Ballavimus.

Your Business Agreement to Indemnify If you are using our Services for business purposes, you agree to indemnify, defend, and hold harmless Ballavimus, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, or expenses (including reasonable legal fees) arising from:

- Your violation of any law or regulation
- Your violation of any third-party rights (including intellectual property, privacy, or other rights)
- Your use of the Services in a manner not permitted by these Terms

Our Rights If we face a claim for which you must indemnify us:
- We will notify you of the claim reasonably promptly (though delay does not affect your obligations unless you are materially prejudiced)

Consumer Rights If you are a consumer resident in Scotland or Northern Ireland, you will also benefit from any mandatory provisions of the law in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
Dispute Resolution for Consumers If you are a consumer and a dispute arises between us, we encourage you to contact us first at hello@ballavimus.com to try to resolve the matter informally.
If we cannot resolve the dispute informally, you may:
- Bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland (depending on where you live or choose to bring a claim)
- Use an Alternative Dispute Resolution (ADR) provider - we will provide details if requested
Jurisdiction for Business Purchasers If you are purchasing as a business, you agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Services.

Our Right to Make Changes We reserve the right to update, change, or replace any part of these Terms of Service at our sole discretion by posting the updated Terms on our website.
Notice of Material Changes If we make material changes to these Terms that affect your rights, we will notify you by:
- Email to the address associated with your account (if you have one), and/or
- A prominent notice on our website
We will provide such notice at least 30 days before the changes take effect, where reasonably practicable for us.
What Constitutes Material Changes Material changes include, but are not limited to, changes affecting:
- Your payment obligations
- Your cancellation or return rights
- Our liability to you
- How disputes are resolved
- Your data protection rights
When Changes Take Effect Changes to these Terms will take effect on the date specified in our notice. For material changes, this will be at least 30 days after we notify you (unless a shorter period is required by law or necessary for security reasons).
Your Options If you do not agree with the updated Terms:
- You may stop using the Services before the changes take effect
- For material changes that negatively affect your rights, you may cancel any ongoing orders or subscriptions in accordance with our cancellation policy
Acceptance Through Use Your continued use of or access to the Services after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Services.
Orders Placed Before Changes Terms in effect at the time you placed an order will govern that specific order, unless the change is required by law.
SECTION 24 - LIFETIME SUPPLIER’S WARRANTY
We work with one of the best bookbinders in the UK. We are confident in the build quality and design we have chosen together. We offer a lifetime warranty for all our diaries, as outlined below:
What’s Covered:
- Binding coming apart
- Pages falling out
- Faulty embossing
- Material defects in the cover or paper
What’s Not Covered:
- Normal wear and tear from use by customers (e.g., scuffs, scratches, fading from sunlight)
- Damage caused by spills, stains, fire, accidents or use of the diary for purposes it was not intended for
- Changes due to decades-long use (e.g., slight pages yellowing, slight softening of the leather, damage from very frequent, unreasonable or hard use)
- Modifications or repairs made other than by the Supplier
How It Works:
· If you finds a manufacturing fault, email us with photos and your proof of purchase. We'll review your email as soon as possible.
· If we accept the fault, we'll repair or replace your diary at no cost to you. If your diary model or colour is no longer available, we’ll offer the closest equivalent. We will replace any custom embossing, like-for-like, free of charge too.
SECTION 25 - GIFT CARD POLICY
· Validity Gift cards are valid for 48 months from the date of purchase.
· Use Gift cards can be redeemed online at www.ballavimus.com against any products. Multiple gift cards can be used per order. If your order exceeds the gift card value, you must pay the difference. If your order is less than the gift card value, the remaining balance stays on the card for future use.
· No Cash Value Gift cards cannot be exchanged for cash and no change will be given.
· Lost or Stolen Cards We cannot replace lost, stolen, or damaged gift cards. Treat your gift card like cash.
· Non-Refundable Gift cards are non-refundable. If you return goods purchased with a gift card, we'll refund the value back to the gift card (if still valid) or provide a new gift card.
· Our Right to Cancel We reserve the right to cancel gift cards if we suspect fraud or misuse.
· Changes to Terms We may update these terms at any time. Current terms apply to all gift card purchases.
· Your Consumer Rights If you purchase a gift card for yourself and change your mind, you have 14 days from the date of purchase to cancel and receive a full refund (this is your legal cooling-off period for online purchases).
